The amendment to the Constitution provides that there will be no tenure extension for a sitting president/governor who wins a rerun election. They can serve only a maximum of four years at a go.

In the case of the President, the new subsection that was proposed by the Senate was 135(c) which provides
"in the determination of the four year term, where a re-run election has taken place and the person earlier sworn in wins the re-run election, the time spent in the office before the date the election was annulled, shall be taken into account."
In the case of a Governor, the new subsection was 180(c) which provides that "in the determination of the four year term, where a re-run election has taken place and the person earlier sworn in wins the re-run election, the time spent in office before the date the election was annulled, shall be taken into account."

I think that it was the Senate provision (rather than the House, which had no provision on the Presidency) that was adopted in the harmonized version that was sent to the State legislatures.

QUESTION:  Should governorship elections hold next year in Kogi, Ekiti, Adamawa, Cross River, Bayelsa, and Sokoto  states?
 
ANSWER:  The matter is in two parts: Kogi, Adamawa, Cross River, Bayelsa, and Sokoto  were states where elections held throughout the state, and could have a fresh mandate.  It has now been ruled that Ekiti can not enjoy such a status because there was no total re-run, elections were done in a few places (10 of the 16 councils in the state, 63 of 177 wards (less than half), and - most importantly - 796 out of 2,195 polling units (just over one-third) ).
 
And none of the other re-runs had an REC like Madame Ayoka Adebayo who played a disappearing act, nor was any of them held on two separate days,, nor the torture of journalists and observers !  Haba!

The first governorship election to be re-run in the history of Nigeria has been won by Alhaji Ibrahim Idris, candidate of the Peoples Democratic Party (PDP) in Kogi State.
 
Idris, who was governor of the state between 2003 and 2007, defeated a two-time governor and candidate of the All Nigeria Peoples Party (ANPP), Prince Abubakar Audu, with a wide margin.

Idris polled 518, 581, while Audu scored 175,978, but Audu has described the results as unacceptable and has indicated that he would "explore all legal options in seeking redress".

Idris will be sworn in as the new governor today for the third time, although the last one won't count because the April 14, 2007 election was nullified by the Election Petitions Tribunal and the Appeal Court following the unlawful exclusion of Audu by the Independent National Electoral Commission (INEC).

Last Saturday, a total number of 734,625 votes were cast out of which 35,006 were declared invalid. The state has 1,365,641 registered voters.

Candidates and their scores are: Mr Abu Danlami (ADC), 162 votes; Mr Salihu Ibrahim (APGA), 490; Mr. Adams Ogbeche (ARP), 87; Mr. Rotimi Obadofin (DPA), 233; Prof. Yusuf Obaje of DPP, 1259; Mrs Ramat Momoh (PAC) 1,529; Dr Jacob Abdullahi (PPA) 977; Ahaji Muhammed Yakubu (PSP), 88 votes; and the NDP candidate, 235.

Details of the results from the 21 local government councils of the state as declared by the Resident Electoral Officer (REC), Mr. Ayo Adakeja, who is the Returning Officer, showed that Idris won in nineteen local government areas, while Audu won in two.

Collation of results went on peacefully within the INEC office at the Marine Road in Lokoja.

The results were collated in the presence of these INEC National Commissioners: Setley Dadze, Ekpeyong Nsan and three Resident Electoral Commissioners from Enugu, Adamawa and Lagos States, and the Kogi State REC, Adakeja.

The Electoral Officer for Ibaji Local Government complained that electoral materials were hijacked in the five units of a ward, forcing Adakeja to immediately announce the cancellation of the results from those units.

Also in Ofu Local Government, results of nine out of the fourteen units in the Ejule-Alao wards were cancelled following reports from the Electoral Officer that the polling officer was kidnapped and taken to a secluded area, although she refused to sign the results.

In Dekina Local Government, there were rumours of violence, but the Electoral Officer said that there were no specific reports of violence except in Ogbabede registration area, where the polling officer was dragged to a secluded place and ballot papers thumb printed, but the results in the units were also cancelled. In all, results were cancelled in seven units.

In some of the units, the presiding officers did not turn up, but the Electoral Officer converted the polling clerks to Presiding Officers, even at that elections did not take place in the units.

Agents of ANPP complained that there was no voting in some areas. They also complained of violence in Ankpa, Yagba East and Kotonkarfe local governments.

But the Kogi REC called on the Okene Electoral Officer, who said that materials for elections were received well ahead of time.

He said in the presence of security officers that there was no report of violence.

He added that Senator Ahmed Ohiere only complained of violence and he advised him to put his complaints in writing.

On allegations of ballot snatching in Ankpa, Adakeja said that the affected areas were cancelled and that was "enough justice for the area".

In his reaction, Audu cried foul, saying the election was rigged against him by INEC. Audu said that there were verifiable instances of rigging and that violence marred the entire election.

According to him, "I will return to the familiar track of going back to the tribunal and I am sure that victory will come my way at the end of the day."

Audu also said: "I was comforted by one fact, which is that when the whole world said the worse election ever conducted in this country was April 2007 election and Iwu said it is the best election and if given the same opportunity, he would do the same thing again and he has done it.

"I am going to protest by filing the necessary papers at the tribunal or the court of law. That is the stand of myself and all the parties in the alliance."

However, Idris has described his victory as "victory for democracy".

Speaking with newsmen after his election, the new governor elect said that he is grateful to God for his second victory and stated that his election for a second time is a testament for a second sacred duty towards development and improved welfare of his people.

"I will commence my development and welfare programme without delay and will make deliberate efforts to correct the mistakes of the past," Idris said, while also extending a hand of friendship to all his opponents in the onerous task of moving the state forward.

Idris also commended the people of the state for his re-election, describing it as a "great show of love" promising that one good turn deserves another.

He also commended his supporters for standing with him, in moments, he described as moments of grief and glory.

Idris who described his latest victory over Audu as a new dawn, promised to use the renewed mandate for the overall glory of the state.

Nyako wins Adamawa re-run guber poll

ALHAJI Murtala Nyako was returned yesterday as governor of Adamawa State having won Saturday's governorship re-run election.

He got 361,729 votes against the 201,767 polled by his closest rival, Alhaji Ibrahim Bapetel of the Action Congress (AC).

Alhaji Nyako won in each of the 21 local government areas of the state.
The AC in its immediate reaction dismissed the re-run election as yet another "big farce with the result sold to the highest bidder."

The result was announced by Dr Abdul Bulama, the State Resident Electoral Commissioner.

While jubilation erupted in Yola after the declaration of the result, Chief spokesman for the AC, Alhaji Lai Mohammed, who was also in Yola to monitor the election said:

"Never in the history of elections in Adamawa State has one party ever won all the local government councils given the diversity and plurality of values, religion, ethnic and cultural mix of the state.

"The so-called victory by the People's Democratic Party (PDP) does not reflect the true wishes of the Adamawa people who trooped out in large numbers to vote for the AC and its candidate in the election, Ibrahim Bapetel.

"The results declared by INEC does not reflect what happened on the ground throughout Adamawa State on Saturday.  In due course, the AC will provide its tally of the results from all the polling stations and Nigerians will be shocked by the depravity of the PDP-led Federal Government." 

According to him, "the PDP government has shown its determination to foist a one-party rule on Nigerians by rigging itself to power in every state of Nigeria.

The sham re-run election has also proved the hollowness of the government's much touted electoral reform, rule of law and war against corruption. We expect the PDP, INEC and their accomplices to dismiss us as bad losers.

But by the time we release the full and sordid details of what transpired at the public auctioning of Adamawa State governorship seat, Nigerians will be shocked to their bone marrows at the complicity from the highest echelons of government, the PDP, INEC and other institutions entrusted with the conduct of the election."

Lagos — PEOPLE'S Democratic Party (PDP's) candidates in Saturday's governorship re-run election in Bayelsa State, Chief Timipre Sylva; and Sokoto State, Alhaji Aliyu Wammako, have been confirmed winners of the elections.

In the results declared yesterday, Chief Sylva polled 588,204 votes. Prince Ebitimi Amgbare of the Action Congress (AC), his main challenger, had 26,635 while Alhaji Wamakko got 562,395 to defeat Ahaji Maigari Dingyadi of the Democratic People's Party (DPP) to a distant seven of 124,046.

Imoke wins Cross River election rerun

THE Peoples Democratic Party candidate and former Governor of Cross River State, Senator Liyel Imoke, has won the governorship rerun election conducted in the state on Saturday.

Imoke polled 650,723 votes to beat eight other candidates in the governorship race which took place in all the 18 local government areas of the state.

Announcing the result of the election on Sunday, the State Resident Electoral Commissioner, Mr. Josiah Uwazuruonye, said the result represented the true performance of all the political parties in all the local government areas.

Imoke, whose election was annulled by the Appeal Court in Calabar on July 14, 2008, beat his closest rival from the All Nigeria Peoples Party, Senator Paul Ukpo.

Ukpo came second in the race with 15,734 votes while his counterpart from the Progressive Peoples Alliance, Mr. Iheke Awa Solomon, came third with 2,072 votes.

The Democratic Peoples Party governorship candidate, Dr. Eyo Etim Nyong, came fourth with 1,952 votes, while Mr. James Ebri of the African Renaissance Party polled 1,951 votes to the at the fifth position.

Mr. Innocent Okey of the All Progressives Grand Alliance came sixth with 1,912 votes with his counterpart from the National Democratic Party, Dr. Rose Okoji Oko, getting 1,404 votes to be at the seventh position.

Uwazuruonye expressed satisfaction at the peaceful conduct of the rerun election.

He said the Independent National Electoral Commission had earlier assured the people that it would conduct a hitch-free poll. He added that the officials of the commission and security agents worked hard to ensure that the exercise was free and fair.

Also, the Chairman of Pan-African Peace Initiative, Rev. Peter Okosun, called on all the political parties that lost in the rerun to see the exercise as a game and prepare well for another day.

He added that the election was peaceful in the 10 local government areas he and members of his group visited.

However, Imoke's opponent who contested the re-run on the platform of the ANPP, Senator Paul Ukpo, said in a telephone interview with one of our correspondents on Sunday that the exercise was a farce.

Ukpo accused the Independent National Electoral Commission of merely allocating results to his opponent.

He said, "It was a farce. It was a programmed exercise. At this moment, I cannot realy understand the total disregard for the rule of law.

"INEC is responsible for all that is going on. Results were allocated as far as I am concerned. Election was less than 10 per cent and vote is credited as over 70 per cent. Just like the one that happened in the earlier one, those of us who do not have the money to influence results were shortchanged."

Ukpo also said the court remained his last hope.

When asked if he intended to go to the tribunal against Imoke, Ukpo said, "Yes, we might go to court; but we have not decided on what next to do."

Also, the governorship candidate of the ARP, Mr. James Ebri, said he was too stunned to react to the outcome of the election.

Ebri said, "I really do not want to react to what happened on the re-run election. I cannot say anything. I would not say whether I am disillusioned or not."

There were reports of apathy on the part of the electorate. Many people were reported to have stayed at home while the election lasted with many polling units deserted.

Nigeria: Ekiti Rerun Deadlocked

Ado-Ekiti — Tension and suspense, which enveloped Ekiti State in the wake of last Saturday's governorship rerun, continued yesterday as the Independent National Electoral Commission (INEC) suspended the collation and announcement of results of the four remaining local governments in the state.

INEC also postponed the outstanding election in two wards in Oye-Ekiti Local Government indefinitely.

After violence was recorded last Saturday in Oye-Ekiti, the base of Peoples Democratic Party (PDP) Senator Ayo Arise, INEC initially postponed the election till yesterday. It later shifted the poll till today before eventually postponing it indefinitely.

Meanwhile, spirited moves by some PDP chieftains to get the entire election cancelled have been rebuffed.

Sources said the PDP bigwigs had battled throughout the night to get the election cancelled, but to no avail.

INEC National Commis-sioner from Abuja, Mr. Dayo Soyebi, who announced the postponement of Oye-Ekiti election, said a new date would be communicated to the parties at the appropriate time.

Soyebi told journalists that collation of results of the four remaining local governments would be done after all the election had been completed.

A statement late last night by INEC said the election in the two wards in Oye Local Government scheduled for today would no longer take place as announced.

"The commission is compelled to suspend the election due to security and logistic reasons. A new date would be announced subsequently in accordance with provisions of Part 4 Section 27 of the Electoral Act 2006," INEC said.

The Resident Electoral Commissioner in charge of the state, Mrs. Ayoka Adebayo, was nowhere to be found at the time of the postponement.

Adebayo said she excused herself from the collation centre on ground of ill-health.

But it was learnt that Action Congress (AC) leaders and other opposition leaders had insisted that she must be the person to announce the result at the collation centre.

Lagos-based lawyer and an indigene of the state, Mr. Femi Falana, was said to have raised an objection to Soyebi taking charge at the collation centre.

Quoting Section 31 of the Electoral Act 2006, he insisted that the Ekiti REC must be produced to announce the result.

Speaking with THISDAY later in a telephone interview, Ade-bayo said she was not in Ado-Ekiti, adding that the situation there was tense.

"I' m not around in Ado-Ekiti now. The situation there is tense. My life is at stake and I cannot do anything that is against my God and my conscience," she said.

She denied that the INEC office in Ikere-Ekiti was burnt, but however confirmed that the commission's office at Ido-Osi Local Government was torched.

Results from five local governments had been released after the rerun in which former governor of the state and PDP candidate, Chief Segun Oni and AC candidate, Dr. Kayode Fayemi, were the major contestants.

Results from Gbonyin, Ekiti South-west, Ise-Orun, Ijero and Irepodun local governments showed that PDP polled a total of 15,420 votes as against AC's 15,026 but this is exclusive of the over 11,000 votes which AC had to its advantage from the last April 14, 2007 election.

The rerun in 63 wards in 10 local governments of the state was ordered by the Court of Appeal following the electoral challenge mounted against Oni's election by Fayemi.

Violence clashes erupted again in the volatile Oye local government.

Again, no less than 39 suspects were arrested by the police while they were trying to foment trouble.

Eight men were picked up in Oye-Ekiti while trying to smuggle 12 pump action guns into the town.

The policemen who had mounted a road block in front of Senator Arise's house had stopped the entourage of another senator from the state, Femi Kila, who drove in a convoy of three vehicles including two Hilux Vans used by the senator as back up vehicles.

When police searched the Hilux vans, 12 guns were discovered inside them and were immediately confiscated by the police which also arrested the men.

Journalists were not spared by the attackers in Oye-Ekiti as Segun Bakare of the Punch, Dare Fasube of Vanguard and David Idowu of the Horizon were beaten seriously and their cameras seized.

Both PDP and AC have continued to trade allegation of rigging.

The situation around the collation centre at Chris Girls School, Ado-Ekiti within the vicinity of the popular Fajuyi Memorial Park was chaotic.

Several youths believed to be members and supporters of AC gathered in groups in a bid to prevent attempt to bring already thumb-printed ballot papers for final collation.

Majority of the youths, who looked desperate had laid siege to the area since Saturday.

The situation almost went out of hand between the hours of 9 am and 10 am yesterday, when the youths took to the streets chanting war songs, threatening mayhem should the INEC decide to announce any result different from the ones collated at the designated collation centre.

Amid the tense atmosphere, especially within Ado-Ekiti, the state capital, PDP and AC addressed press conferences at their state secretariats almost adjacent to each other.

PDP Public Relations Officer (PRO) Lekan Adekanbi called for the cancellation of the vote cast at Igbemo ward in Irepodun/Ifelodun Local Government, while he also appealed to INEC to allow the people of Egbe/Iro ward in Gbonyin Local Government who have been allegedly disenfranchised to perform their civic duties.

According to Adekanbi, election in Igbemo needed to be cancelled because, according to him, a lot of malpractices and electoral fraud took place.

"Elections were not held in this particular area," he said.

While expressing satisfaction with the conduct of the election as well as the outcome so far, Adekanbi said his party, PDP, had no doubt performed creditably well.

He, however, said the party would abide by the outcome of the results of the entire election.

AC Chairman in the state, Chief Jide Awe, raised alarm that the Presidency had allegedly ordered INEC in the state to announce the results of the 11 wards in Ido-Osi Local Government, which allegedly were not collated at the designated collation centre and not signed by the AC accredited agents.

According to him, only three wards in the area, two in Ayetoro and one in Ido, where elections were properly conducted and collated would be acceptable to the party.

Awe said information at the disposal of the party indicated that Vice-President Goodluck Jonathan was mounting pressure on INEC to announce another result different from the one already known to the generality of Ekiti people.

While appealing to INEC not to set the state on fire by announcing the results of the election that was not properly collated, Awe urged the Presidency to allow the will of the people to prevail.

Expressing regrets about the situation in Oye-Ekiti, the AC chairman blamed INEC for announcing the postponement of the election in the community for the second time.

"The election was to hold today (yesterday) we got there and nothing happened. We were there for several hours, until about 12pm when we heard an announcement that the election has been postponed till tomorrow (today)," he said.

AC has, however, formally rejected the result from Ido-Osi local government, describing it as an "unimaginatively fabricated result that cannot stand any scrutiny".

In a statement by its National Publicity Secretary, Alhaji Lai Mohammed, the party said the result from Ido-Osi, which gave the PDP 15,939 votes against AC's 3,793, was the most improbable result and could only have been made possible by sheer cooking of figures.

Mohammed said: "After collation of results from five local governments (Gboyin, Ekiti South-west, Irepodun-Ifelodun, Ise-Orun and Ijero), on Saturday, the AC had 15,026 and the PDP 15,420 votes, without counting AC's existing credit of 11,000 votes.

"Realising the PDP's deficiency with results from just four local governments remaining, the collation was suspended till Sunday. Overnight, however, the cooked results - said to have been collated in a police station without AC agents in attendance - surfaced, with the PDP winning 15,939 in just one local government!

"That result simply cannot stand: First, it shows that the PDP, in collusion with INEC, simply worked from answer to question, having realised there is no way the PDP could catch up with the AC. Secondly, the improbability of the figure from one local government alone more than all the total votes scored by PDP in all the five local governments whose results were collated on Saturday!!!.

"In fact, in one particular ward at Ido-Osi, the AC was disingenuously awarded a zero vote! Therefore, we say that the result from Ido-Osi - and consequently the overall outcome of the rerun, cannot stand; that we will not accept it, and that we will defend our votes with all lawful means necessary."

Why Oye-Ekiti is Critical

Two wards in Oye-Ekiti, the home base of Senator Ayo Arise (PDP), boast of 18,000 registered voters. Whoever wins here may have an unassailable lead.

Federal High Court says Oni's tenure ends in 2011

 

The contentious issue of when the tenure of Engnr. Segun Oni, governor of Ekiti State ends had been resolved by a Federal High Court sitting in Jos this morning.

 

In a judgment delivered by Hon. Justice Ambrose. Alagoa of the Federal High Court sitting in Jos, in a suit filed by Adunmo Rufus and 3 others vs Attorney General of the Federation, ruled that the tenure of Gov. Segun Oni ends next year (2011).

The judge said the election of Segun Oni was not a fresh election but a Supplementary one which was combined. He further said that the oath he took in 2007 is the recognised oath by the constitution and that the 2nd oath he took in 2009 was only a complimentary one.

The matter originated from Ado-Ekiti and when it reached judgment stage, the trial judge was transferred to Jos. The President of the Federal High Court gave Hon Justice Alagoa the fiat to deliver the judgment in Jos.
