It is untrue that Nnamdi Kanu has been held for 90 days without being charged to court. On December 23, 2015, Nnamdi Kanu refused to take a plea before a High Court judge, Justice Ahmed Mohammed, claiming he did not trust the judge would give him fair trial. Consequently, Justice Ahmed Mohammed withdrew from the case and transferred the case file back to the Chief Judge for reassignment to another Judge.
It was revealed that two associates of Kanu, Benjamin Madubugwu and David Nwabuisi were to be arraigned with him on a six-count charge of treasonable felony on 23 December 2015.
It was also disclosed that Nnamdi Kanu has a Nigerian Passport with his name as Nwannekaenyi Nnamdi Ngozichukwu Okwukanu and a British Passport with his name as Nnamdi Kenny Okwukanu. He did not enter Nigeria with either his Nigerian or British passport. When Kanu was arrested on the 14th of October 2015, in room 303 at the Golden Tulip Essential, Lagos Airport Hotel, located at 42/44 Murtala Mohammed Airport Road, Ikeja, Lagos, it was discovered that he had checked in with a fictitious name Ezebuiro Nwannekaenyi and was surrounded by broadcasting and communication gargets set for use. Beside that, arms and ammunitions traced to Kanu had been imported into the country and lodged at the Ibulusiuzor, Ihiala Local Government Area of Anambra State home of Benjamin Madubugwu, Kanu's associate. David Nwabuisi is a maintenance engineer employed by Ericsson, the Company managing mast sites for MTN in Nigeria. He was arrested on July 15, 2015, for helping to install a Radio Biafra transmitter on an MTN mast in Ngwo, Enugu State. Radio Biafra's transmitter operated for three months before it was discovered on 7 July 2015.
In truth and fact, the Chief Judge might still be looking for a Judge that is acceptable to Kanu to assign the case to and pending that, Kanu cannot be released for any reason as treasonable offence is not bail-able.
