Be sure you are not miixing apples and oranges here. To the best of our knowledge, there was no issue about Clinton versus Obama contesting the Presidency in 2008; However, in Nigeria, some people are saying that GEJ cannot contest, which is radially different from the Clinton-Obama saga. Second, on State-by-State basis, Obama won more legitimate delegates (according the Comstitutional Federal Constituencies) than Clinton, although Clinton received alot in the big States. So why are you bringing in the issue of how the Democratic party wanted the States to conduct the primaries or lose their voting rights into this PDP issue that is anchored on some members trying to prevent Jonathan from contesting an election?
A more tenable comparison is the manner of choice of delegates that PDP has been working on; if there is a problem with the Governors and legislators operating as the only delegates versus other party officials, we can agree that they should settle that issue within their party and move on. But the fundamental issue of who contests an election in any party in Nigeria is a Constitutional Right that a party cannot decide alone with its rule and without taking the national Constitution into consideration. No serious political party will even go there, as the PDP has rightly done in saying that Jonathan can contest for Presidency, because they understand the Human/Citizens Right, Constitutional and legal implications. I stand by my point. A party or group of people has the right to set up rules and regulations (Governing Council) in order to maintain decorum in their deliberations and activities.
A party constitution is a governing rule of the party in order to maintain order.
Joe, GEJ has no option than compete under the rules of his party, if he wants to exercise his constitutional right, he will need to move to another party.

May 31st, 2008 The Rules Committee of the Democratic Party has unanimously agreed to give Florida Democrats half their delegation, and has also agreed to give Michigan Democrats half as well. All individuals from those two states will be seated, each with a half-vote. The Florida apportionment of delegates matches the results of the Florida presidential primary. The Michigan apportionment does not match the results of the Michigan Democratic primary, since Barack Obama’s name was not on the Michigan Democratic ballot. Instead, Obama get 59 Michigan half-delegates, and Hillary Clinton gets 69 Michigan half-delegates. Some of the Clinton supporters are still unhappy about today’s compromise and may ask for a revision from the national Credentials Committee.

Isnt more accurate to say that the party rules are supposed to be in harmony with the nation's contitution and such rules would yield to the nation's whenever there is conflict, than to say "...the court always defer to party rules and constitution in the selection of candidates."? You dont really mean that the court would allow an organizational rule to supercede the equivalent national rule because it is for internal operation. I say: No Jose! When it comes to party election, party constitution and rules is the ultimate inasmuch as the fundamental human rights of anyone as stated in the Constitution is maintained. The same way Churches, Rotary Club, NIDO, even Oba, Obi, Emir etc., selection have lay down rules and constitutions.
Some of these rules and regulations in the selection of representatives are not into-to with the constitution of the land.
If we are to go along with your argument about conflict between party constitution and national constitution, we would have President Hillary Clinton instead of Obama. Hillary won all the big states with the most delegates. But because of the proportional allocation she lost to Obama. Whereas in the Republican Party, it is winner takes all.
The US constitution is winner takes all, the Democratic constitution is proportional delegates apportionment. Not only, that Barack Obama needed the support of Super delegates on elected party members to reach the finished line.
So my brother, the court always defer to party rules and constitution in the selection of candidates.
The people and the court are not saying GEJ can not contest the election, but he can not contest the election and represent PDP under current PDP rules and regulation in selecting their presidential candidate. That is the GEJ dilemma here.

This is a warning to Jonathan and his supporters. If PDP presents Jonathan, he would be disqualified by the court. His election would have contravene the party constitution and then the prayers of aggrieved person(s) would be granted.
The only hope for Jonathan is to fight to change PDP's constitution about zoning or move to another party to contest.
