Besides, I have not read a ruling against GEJ's candidcy yet or that he should not contest if his ticket respects the the PDP zoning system; and who says a Jonathan-Sambo ticket does not fulfil the present zoning arrangment of PDP; it was North-South during Yar'Adua's time; it is South-North at this time; I dont see any South-South or North-North, East-West, or Ijaw-Edo ticket that would warrant a radical concern for those interested in zoning the Presidency to the North. It continues to be North-South or South-North as it was previously! Or is there a selfish interest being pursued under the guise of a REGIONAL FIGHT here? Are these not the same people who were against GEJ taking over from Yar'Adua accoding to the national Constition, arguing that somebody else should be President while Jonathan remainED VP? Something MUST be WRONG with some Nigerians and their sense of Human Justice. Wallahi!

In any case....PDP zoning policy should be weighed against the constitutional provisions.
In the case between Plateau PDP against PDP National Working Committee (NWC), the Court of Appeal sitting in Jos and presided over by Justice Monica Dongban Memsem, on November 19 2010, said the pre-amble to the constitution of the PDP says it will have respect for the rule of law, upholding fundamental rights of its members and promoting democratic values which will be subject to the 1999 constitution which shall be supreme.
She also averred that Article 32 of PDP constitution is subject to the constitution of the country where members are at liberty to go to court to seek redress where they feel their rights are infringed. She added that to ensure internal democracy, citizens should be bound by the constitution absence of which there will be anarchy.
The justice said that although members of a political party are bound by the party constitution, legal redress provided for by the Nigerian constitution must not be flouted. She said that the respondents did not say that they were not bound by the constitution of the party, but that before they were removed they should have been given a fair hearing.
She said that since they were elected for the period of four years, their dissolution should have been tabled before the national convention of the party. “Their rights cannot be taken away except by the 1999 constitution of the Federal Republic of Nigeria through the courts.”
In today's trial His Lordship ruled as follows:
1) That the preliminary objection brought by GJ challenging the suit succeeds;
2) The originating summons filed by Atiku's supporters dismissed.
But underscore His Lordship made the following pronouncements:
A) That Article 7(2) c of PDP Constitution having stipulated zoning, party members must respect it;
B) That PDP not having presented candidate GJ or any other as its presidential flagbearer, its too soon to seek to disqualify anyone.
C) That there is no sufficient cause of action as a result of B

But....I hate to be a CONSPIRACY THEORIST!!!
Having said the above, I agree more with the earlier court ruling against a Presidential aspirant, Alhaji Aminu Dutsinma; that the court lacked the power to direct PDP on how to implement its zoning arrangement. Justice Gummi in that earlier ruling observed that although PDP recognised zoning in its constitution, the party did not state in specific terms how the zoning formula would be adopted.

We all live in civilized communities, and members of different social clubs.
GEJ/UMYA were elected under PDP constitution for 4-years. If not for the party constitution, Peter Odili would have won the nomination to represent PDP in 2007. He had all the delegates bought, before Mr. "Old Tortoise"-Obasanjo tricked him with a VP position because of PDP Zoning constitution.
GEJ has constitutional right to contest for the position of the president, but not under PDP except the constitution is amended.
This is the song some of us most especially Professor Aluko has been singing all these months. He should have fought to change the constitution of his Party before declaring his intention, and if not allowed, threatened to move to another party.
It is not a happy day in Aso Rock today.

You need to read Idowu again....political parties are like clubs, with rules and regulations having little or no cognizance whasoever of a nation's constitution.
