Collective ownership demonstrated through consistent use of the land is still ownership and falls under Common Law - even the English had shared Commons. What is missing is written ownership - that was the colonials' final loophole. A non-literate society cannot hope to find fair footing in a literate court system. Although African societies quickly worked to close that loophole, as they began to understand the "treaty" paper system of the colonials and use their sovereign states to dictate terms. In the end, as we all know, it had nothing to do with whether or not anyone owned the land, but who had sufficient forces to keep it.

My Irish history professor made the same claim. The Irish didn't really "own" the land because they divided it up differently each planting season. Therefore the English didn't really steal it.
