Re: USA Africa Dialogue Series - Bukola Saraki's election as Senate President should be challenged in court

1, You have hit the main issues with exactitude.
2, The issues should be resolved without historical, social and political fripperies nor pedantic waggles.
3, This strategy is not acceptable in any civilization or civil society.
4, The Presidency needs to get that feedback swiftly to curb its premeditated, real or imagined excesses.

I would suggest that the election of the Senate President should be
challenged in court for the following reasons:

1. A Senate President cannot emerge from a vote that deliberately
disenfranchises the majority of the majority. The 51 senators did not
abstain. They were simply maneuvered. This may sound like a shrewd
political play, but the question of its constitutionality remains
unanswered.  It sets a dangerous precedent that is undemocratic. I can see
the majority party sneak into the chambers to set up a kangaroo assembly
and vote on any controversial bill in the future in the absence of the
majority of the minority party. The deliberate disenfranchisement of
senators as a means of achieving a political goal should be challenged in
court now before it becomes a method of choice to circumvent majority
rule.

2. It has been argued that the election took place within the limits of
the constitution. We don¹t know this. We should not presume we know this
or simply accept it because the party and the president have accepted it
as a political compromise. This should be for the supreme court to decide.
There are too many constitutional issues here that we need the guidance of
the courts to resolve.
