Transfer pricing is a settled practice in international investment and trade. It very well known too that it is very subject to abuse. All serious host country governments monitor its practice and have mechanisms to ensure that abuse is minimal. Transfer pricing does not suddenly happen. Foreign investors build in opportunities to take out as much money as possible out of host countries in their international venture contracts, within existing host countries' laws. Host countries and firms paying attention, look out for them during negotiations and prevent as many of them as possible. Once contracts are agreed and approved and license issued, it is very difficult to prevent fund transfers when they are covered by contract terms and provisions, and are not inconsonant with host countries laws. Host countries' governments and firms may seek to renegotiate contracts but it may not happen before the renewal of agreements, or license where that applies.
It is always important that host governments pay attention to international venture agreements when theirs is the host country. Was the MTN venture contract diligently vetted by the responsible government agency before MTN was issued with a license to operate in Nigeria? International venture contracts are usually not perpetual contracts. Contracts are usually reviewed when they come up for extension. Has this been done with MTN? If contract terms and provisions, and host countries' laws were broken, exited funds are adjudged to have been repatriated illegally and their return may be demanded. The question usually is whether corruption will not in time, deflate the resolve of host countries' government and other public officials to ensure and insist that illegally transferred funds be returned, in some case with penalties. As would be expected, foreign firms may choose to fight back, seek international arbitration, go to court, and of course involve their home governments in the fight.
Public morality as it pertains to government and other public officials is always important. The more corrupt these officials are, the greater the abuses of transfer pricing are likely to be. Many government and public officials have a price. Once paid, they tend to look away.

EVERY LAST ONE of international companies does this "transfer pricing"
trick, including TO their home countries, including even to the US.
It is a SHELL GAME...and it is NOT NEW....
In 1978, in a required Chemical Engineering course on International Development for my MS Thesis, I chose MNCs (Multi-national
corporations) for my thesis, and in zero-ing in on a sub-topic, I
alighted upon "Transfer Pricing." It looked quite ingenious at the
time - inflated salaries to expatriate employees, inflated prices for materials sole-sourced from "friendly" home companies - including home branches - and inflated management agreement fees, etc., all to suppress taxes paid to the home country. Companies would ship goods from one country to another before getting to a third country - at a desirable high price - so as to depress profits, etc.
It was at the end that I suspected that something was wrong here....but that was not how it was always presented.
Again...all foreign companies, not only MTN, do it, and now that MTN has been "caught", it is time to investigate all the other companies
too. In the US, it is a constant battle - and companies so caught
have a high penalty to pay.
