USA Africa Dialogue Series - On the Matter of Ministerial Portfolio under PMB - or None {Re: All ministers will get portfolio – Presidency

You too have probably joined me in going from bad to worse?

Please come with me....

Just yesterday, you wrote that I have of recent gone "quiet", I guess because you feel that I had become disenchanted with the PMB administration, but didn't wish to convey it publicly..  Now, you say that I have "gone nuclear" since INEC announcements...apparently because I was not announced (as you prayed with me) as INEC Chairman? 

Which is which, Pastor Joe?

Moving on now to your submission, below, 

The two controlling phrases in the sentence on ministers without portfolio are "...purely presidential..." and "..uncommon.."

First, "uncommon" does not mean "impossible" or "never done."  For one, with people like Akpabio, Nigeria is an "uncommon country!"  Secondly,  Nigeria's system is NOT purely presidential like the United Stnates, otherwise its Constitution would NOT specify one minister per state.....or else the United States would have 50 MINISTERS, and I bet you it too would be looking for seats, benches and portfolios for them too!  Our Constitution took the Federal Character sentiment too far by specifying one minister per state - it was also not far-sighted in thinking of future expansion of states? - and could have specified a cluster of contiguous states (which we now call "geo-political zones") not exceeding eight or ten.  In these days of lean finances,  carrying anywhere near 36 ministers is ridiculous, particularly since with local governments, state governments and legislatures and federal legislatures (Senate and House), the People have enough REPRESENTATION on a state-basis.

The first Cabinet of the US began with 4 persons (until first President Washington), but ever since that number has been up and down, but now under President Obama, in addition to Vice-President Biden, there are 15 of them called Secretaries who are Heads of designated Government Offices:

1. Secretary of State
2. Secretary of the Treasury
3. Secretary of Defense
4. Attorney General
5. Secretary of the Interior
6. Secretary of Agriculture
7. Secretary of Commerce
8. Secretary of Labor
9. Secretary of Health and Human Services
10. Secretary of Housing and Urban Development
11. Secretary of Transportation
12. Secretary of Energy
13. Secretary of Education
14. Secretary of Veterans Affairs
15. Secretary of Homeland Security

If you notice what I sent out earlier, our 1999 Nigeria Constitution specifies by name ONLY five "ministers" to the President:

   - the Vice-President (who shall be Chairman of the National Economic Council, Deputy Chairman of Council of State, National Defence Council and National Security Council)
   - the Attorney General (who shall be a Member of the Council of State (the only sitting Minister to do so), the Federal Judicial Service Commission of the Federation and also of the Federal Capital Territory, Abuja) 
   - Minister of Defence (who shall be a Member of the National Defence Council and National Security Council)
   - Minister of Interior (who shall be a Member of the National Security Council)
   - Minister of Foreign Affairs (who shall be a Member of the National Security Council)

All others can therefore be assigned COMPLETELY to the discretion of the President...or nothing at all...

Clearly, PMB is leaning (no pun intended) to no more than 16-20 ministries total, around half of the number of ministers un-mercifully required by the Constitution, and substantially less than the 28 or so under GEJ and previous administrations.  I trust that they will have a few of the following (eighteen to twenty-one), but we shall see:

6 Infrastructure

21 Land, Housing & Urban Development 

As you can see, I am not interesting in your caterwauling - and all your belly-aching "gotcha" of the PMB administration,  but rather how to move the nation forward.  I am also reminded of all the hue and cry that attended President Obama when he began his Presidency following President Bush, when he stuck to his guns as he did his stimulus package, etc......and he pulled the country through it all.

Finally, I hope that during his term, the provision of one minister per state is removed once and for all from the Constitution, in addition to several other provisions in the Constitution that should make it a truly Peoples' Constitution under a True Cooperative Federalism.

And there you have it.

A "Minister of Special Duties" is actually a minister without portfolio.

Even then what this actually meant that some
junior ministers were not assigned specific portfolios
but considered as Ministers at large who are tasked
to accomplish of various duties by the Prime minister
as he deemed fit during his tenure.

The idea is accommodated in our current Presidential
system by the appointment of Ministers of State
-who are junior ministers assigned to supervise  less demanding
and less critical departments within a given ministry.

I doubt if PMB's initial idea was to have some Ministers without
portfolio sitting at home twiddling their thumbs and getting paid
for doing nothing.

    All ministers will get portfolio – Presidency
    President Muhammadu Buhari
    President Muhammadu Buhari will assign portfolios to all his 36 ministers, the Presidency told Daily Trust yesterday.
    The Senior Special Assistant to the President on Media and Publicity, Mallam Garba Shehu, stated this in a telephone interview with our correspondent yesterday.
    The president had reportedly said Friday that not all the 36 nominees would be ministers as some of them would only sit in the cabinet in order to meet the constitutional provision which stipulates that each state of the federation must have a representative in the cabinet.
    Buhari was reported to have disclosed this during an interview he granted the Nigerian Television Authority (NTA) and Channels Television shortly before he left New Delhi where he participated in the third summit of the India-Africa Forum.
    But the presidential aide stated that all the 36 ministerial nominees that had been screened by the Senate would be assigned portfolios. 
    Shehu clarified that what President Buhari meant was that not all the ministers would have full control of the ministries.
    He said the president would retain the structure in which there are substantive ministers and ministers of state.
    According to the presidential aide, it is not possible to have a more ministries than   the number of ministers.
    Shehu said: "You know we have a structure of government in place in this country whereby there are substantive ministers and ministers of state.
    "What the president meant (in the interview granted) was that not all the ministers in his cabinet will have the full control of the ministries. You know it is not possible to have the number of ministries more than the number of ministers. Even former President Goodluck Jonathan had 28 ministries and 42 ministers.
    "So, what the president meant was that some of his cabinet members would be ministers of state."
    Asked whether this implies that all Buhari's ministers will have portfolios, Shehu answered in the affirmative, saying: "Yes, that is what it means. But not all of them (the ministers) will have the full command of the ministries".
    Meanwhile, the president was  reported to have disclosed in the interview that the country would be lucky if his administration is able to have half the number of the 42 ministers that operated under the last administration.
    "There was no reduction of ministers to 36. What the constitution says, and we cannot work outside the constitution, is that there must be a cabinet representative from each state. Yes, there used to be 42 ministers, I think we will be lucky if we can have half of that now because we cannot afford it. Others may not be substantive ministers, but they will sit in the cabinet because that is what the constitution says and we cannot operate outside the constitution," Buhari was reported to have said.
    A source in the presidency told Daily Trust last week that the president may assign portfolios and swear in his ministers on Wednesday.
    But the Special Adviser to the President on Media and Publicity, Mr Femi Adesina, said the president could communicate when to inaugurate his cabinet.
