I have followed the naming of a dog "Buhari" with amused disposition! Though I must commend Bolaji for his "boldness"to keep responding to the "Free Speech" advocates. Two thoughts keep crossing my mind in all these. First, these advocates most have been greatly disappointed that the name of this "Buhari" is  not  of Mr. President.  So they had to change the focus of their argument and hide under free speech advocacy. But from the contents and tones of their writings it is easy to detect that they are just pretenders. Second, it looks from their arguments, that the only person who has a  right here is the one who named his dog "Buhari. To them the person who complained to the  police has no such rights. My question is when does the right of a person precludes the right of another person? Any one, in my view,
who  holds  this kind of position is,to say the least,  hypocritical.

There are actually four groups of people having these discussions about Chinakwe, Buhari, and the dog:

 

1.  Those who see the aggriever's name as "Chinakwe", and feel it a duty to defend him, because it is an Igbo name.  These are the ones who believe that all attacking Chinakwe are "Igbo haters."

 

2.  Those who see the aggriever's action as pricking the eye of their political foe, Buhari: whether it is the neighbor's Buhari or President Buhari, and are taking secret delight in the "satire."   They are the ones who believe that anybody attacking Chinakwe are doing so because they see President as a demi-god.

 

3.  Those who are enamored about the "western democracy" notion of Free Speech, and believe that "by definition", it should not be abridged by any means necessary.  They are the ones who see anybody who does not believe in unlimited Free Speech as barbarian autocrats, uncivilized.

 

4.  Those of us who believe that while there is in the law books of Nigeria a charge called "possibility of the breach of peace", then a citizen can complain that a particular "free speech" exercise is not really "free" but "common", and hence requests redress in the law courts.  I for one see the first group as paranoid schizophrenic;  the second group as wickedly partisan; the third group as anarchists.  

 

We have all exercised our rights of Free Speech, where no Public Peace has been breached.

 

So there are ethnicists, partisans,  wide-eyed democrats and rule-of-law advocates at the barricades here, including yourself who, like me,  may also be a pandering,  educated fool.

 

By the way, if Chinakwe named his house "Buhari", he would have to get permission from "Buhari" (whoever that might be)  I would permit an elaborate edifice to be named after me, but not a shit-house.

This is the problem with Nigeria when educated men starts pandering to foolishness. It would have been the duty of the police to educate Mr. Buhari and not to pander or gratify his foolishness. Here too Professors Bulaji,  Ayo and others are dancing, tweaking out of shape, bending over for foolishness, trying to convince us that Mr. Chinakwe does not have the right to name his dog, goat, wife, child, father or any thing of his what he decides to name them.

Again, this is not the point - the personality involved is completely irrelevant. This is what we are saying, regardless of whether he named his dog Buhari after the president with another Buhari located in the same neighborhood as Chinakwe where he paraded "... the dog with swagger amongst his neighbours and/ traders who are mostly northerners," is a moot point, meaning his right to name his own property, dog, any name he wants is fundamental HUMAN RIGHTS which transforms "protected speech" and "civil rights".

The police on Monday decried public comments linking President Muhammadu Buhari with the ongoing saga over a dog named "Buhari" in Ogun State.

A 40-year old trader, Joe Chinakwe, was recently arrested and arraigned in court for allegedly naming his dog "Buhari." He has since been granted bail.

Some members of the public have however associated the president with the matter.

The Ogun State Police Command and Zone 2 Police Command, in separate statements, said series of uncomplimentary remarks against the president over the case were uncalled for.

In the statement by the Zonal Public Relations Officer, Muyiwa Adejobi, the police said the matter was grossly misconstrued, explaining that the president has nothing to do with it as it was erroneously perceived.

The police explained that the case before it showed that one Alhaji Buhari, the father of the complainant, Haliru Umar, both of who live in Ketere Area of Sango Ota in Ado/Odo-Ota LGA of the state, were involved.

The statement said, "The attention of the Assistant Inspector-General of Police in charge of Zone 2 Command, Lagos, AIG Abdulmajid Ali, has been drawn to series of uncomplimentary comments and publications in respect of the case of a man, Joe Chinakwe, who was arrested and charged to court by the Ogun State Police Command for naming his dog "Buhari" and wishes to state categorically that the matter was grossly misconstrued.

"The Zonal Command wishes to clarify and set the records straight that the case, as it was erroneously perceived, has nothing to do with the President of the Federal Republic of Nigeria, President Muhammadu Buhari, but with one Alhaji Buhari, the biological father of the complainant, Alhaji Halilu Umar, all of Ketere Area, Sango Ota in Ado Odo Otta Local Government Area of Ogun State.

"The Assistant Inspector-General of Police in charge of Zone 2 Lagos, AIG Absulmajid Ali, appeals to the general public to understand the action of the police in the matter, which is in consonance with the primary duties of the Nigeria Police Force as enshrined in the constitution of the Federal Republic of Nigeria and accept it as a professional way of preventing total breakdown of law and order," the statement said.

On its part, the Ogun State Police Command, in a statement by its spokesperson, Abimbola Oyeyemi, also said the president had no connection with the matter.

"The attention of Ogun State Police Command has been drawn to a story in some section of the media regarding the case of Joachim Iroko who named his dog Buhari and was subsequently arrested and charged to court," the police command said.

It said Mr. Umar reported the matter at the Sango Police Station to report claiming that Mr. Chinakwe provoked him by inscribing his father's name 'Buhari' on both sides of his dog knowing fully well that it was his father's name.

"The suspect was invited and he did not deny the allegation. All efforts to resolve the matter amicably between the two parties proved futile and it was about to degenerate to a serious crisis within the area, hence, the command took a proactive step by charging the case to court in order to avert unnecessary blood shedding," the statement said.

"The command wants to make it clear to members of the public that the case has nothing to do with the President as some media are painting it to be. It is a clear case between the complainant and the suspect whose action was seen as one that is likely to cause breach of peace."

The state police command said it was its duty to protect life and property, as well as to guard against anything that could lead to the breakdown of law and order "which is exactly we did in this case."

So you can see that I do not subscribe to the dog being killed, since it did not name itself....and that is takiing the law into one's hand....

 

But after the dog has been killed, a complaint has to be lodged by the dog owner - killing a dog per se is not a crime....it could be for food, for example - whereupon prosecution for a felony of destruction of property can be made.

 

And who knows....this dog might have died coincidentally to all of these events....Chinakwe will have to find and sue whoever did the killing otherwise....

 

Moving on.....

 

As to my "excitiment", outside of religion, nothing excites me more than a discussion of the position of the individual in the society comprising of individuals, because that discussion defines ALL laws that regulate society.  If you think of each human being as a pebble in water, and his interest as radiating waves, I am always interested in the interaction of those waves, and how far they must go or be inhibited for there to be order in society.

Dog named Buhari: Northerners in my community ganged up, killed my dog

 



He did not envisage what befell him penultimate Saturday, after coming back to his house in Sango-Ota area of Ogun State. Joe Fortemose Chinakwe, 40, a trader, said he was relaxing with his family when one of his neighbours from Niger Republic accosted him and demanded why he named his pet dog 'Buhari'.

Before he knew what was happening, friends of the foreigner also burst into his house and were threatening to deal with him if he failed to give a reasonable explanation.

At this stage, some neighbours intervened and they all ended up at Sango-Ota police station where he was detained for two days before being transferred to the state Police headquarters at Eleweran in handcuff and chain. He was let off the third day after the swift intervention of both the Serikin Hausa and President-General of non-indigenes in the state.

The embattled trader from Okwuzu in Aniocha Local government Area of Delta State said he was traumatized by the incident and still feels so bad especially, when he noticed that his 'lovely dog, Buhari', has disappeared mysteriously after he regained freedom. The father of two bared his mind to our Crime Editor, Emma Nnadozie at Sango-Ota.

"I am Joe Fortemose Chinakwe from Okwuzu in Aniocha L.G.A, Delta state. I trade on second hand clothes popularly known as Okrika. I have a dog for the past one year. I named the dog Bully after buying it because it is very strong and moves fast. I have been living here since 2001. I reside in a place called Petere in Sango here. I love the dog so much that's why I renamed it Buhari."

Why did you choose the name Buhari

I named it Buhari because I found out that the dog is strong. After buying the dog, I named it Bully because of the way it behaved. I decided to change it to Buhari because Buhari, being a military man, the same time, coming back for the second time as a civilian President, he stands on his word.

That is how my dog stands on his actions. So, I love the name so much and as such decided to give it to my dog. I was very surprised how a foreigner who lives around here came and said his father's name was Alhaji Buhari. I have no business with and he went ahead to tell the police. They came to me that night and I was arrested.

Which day was that?

That was on Saturday at exactly 8,30pm. They got me arrested and our neighbours pleaded on my behalf but they insisted on taking me to the station. People were questioning the policeman why I should be arrested over such a trivial issue and gave examples of dogs in the vicinity that bear names of influential and powerful people like Obama, Clinton etc but, the policeman decided to take law into his hand and arrested me.

Even my senior brother has a dog named Obama. One young man called Sunday was also arrested for questioning the police man who was later identified as Sergeant Musa, attached to Sango Police station. When we got to the station, he told me to bring the dog along. I agreed and went to bring the dog. Before I could get home, the Northern community in our area ganged up and killed my dog.

Yes, they killed the dog and I am still searching for the dog. I can forgive anything but that dog in particular, I cannot take it lightly because it is what secures me and I loved it so much.

Are you sure you are not the one that killed your dog?

No, I left my dog in the house alive and went with the policeman to Sango Police station

What happened at the Police station?

They intimidated me and I told them that it is my right to name my dog whatever I wished. My former dog bore the same name with me. Unfortunately, a car killed it. I called it Iroko because Iroko is also my name. I love strong dogs and that's why I decided to buy this one and named it Bully before changing it to Buhari. After intimidating me that very night, they locked me up in a cell with criminals.

I stayed and slept there on Saturday and Sunday. My wife, a pregnant woman with my baby on her back, came to see me with food because I had not taken my dinner when they arrested me but, they stopped her from giving me food. What baffled me much is that the policeman said that the Igbos have fowl brain. I asked him why he said such about the Igbo community when he should only be referring to me and as such, it is not a tribal problem.

He said he had been handling Igbo cases and that they are foolish and have fowl brains and, that I would rot in jail. He said I should watch. I was surprised when they took me to the Divisional Police Officer, instead of listening attentively to me; he directed that they should throw me into the cell. On Monday morning, my case was transferred. The case was moved to Eleweran.

After much interrogation, they chained me and my colleague who came to see me and put us in the van in handcuffs. We all went to Eleweran. When we got there, many policemen were not happy with them for bringing us there. The CP came on Tuesday with the Serikin Hausa and the President of non-Indigenes and other prominent people. We were told not to take it seriously because we are one Nigeria. I was told to forget it all. I was released.

How come you boldly wrote Buhari on both the sides of the dog?

The dog is a hero and I did it. I shaved his hairs and wrote it.

Did you do it to spite the President?

No. no. no. everybody knows that Mr President is a hero. It is not easy to be a military man and rule a civilian government. Everyone can attest to how many times this man has attempted to become the civilian president but because he is a man that has vision, he made it at long last. . In fact, he is a man that inspires people. He is a role model.

Are you comfortable with the situation of things in the country now?

Yes, he is fighting corruption. Not that I am comfortable with the things happening in the country now but I like the war against corruption. The only problem is that we, the less privileged ones, find it difficult to eat. As he is fighting corruption, he should remember the less privileged.

The guy from Niger, what does he do?

He works in a public toilet. My dog stays in my parking store, he does not move around. He ensures my security.

How did he know you call your dog Buhari?

He said that someone told him and he came around and saw it. A friend of my mine named Peter gave that dog to me. I am not happy I lost that dog. The Northerners in my area came together and killed my dog.

So, after all said and done at Eleweran, did they apologize to you?

Yes, they did but it was obvious to me that it did not come from their heart of hearts. One of them even claimed he went to my house that morning to apologize to my wife

Are you still living in the same area?

Yes

Do you feel threatened by what happened to you?

If I am financially buoyant, I would have left the area for them because it is as if they are occupying the whole area, and a word of threat has been dropped already and they said that the country belongs to them. I am still shocked because Nigeria is in trouble. Can you imagine somebody from Niger Republic, a foreigner telling me that my land belongs to him?

How do you feel about this ugly development as a Nigerian and a human being?

With this situation, I believe that a Nigerian should have rights. Nobody should rise up and intimidate one for no reason especially, when he has no one to speak for him. No advocate for that person. And since Nigeria is still bearing the name, Nigeria, and I'm a Nigerian, it is my country too and that is all.

(The detention may be a protective custody, or to ensure that the vagrant accused does not disappear into thin air, to cause more trouble elsewhere.)  If the report does not rise to a charge, then the Police should explain to LT&L why not, and it is likely they will understand.  The Police might then call Chinakwe aside, and advise him that even though what has been reported so far does not rise to a chargeable offence, there are things that he might continue to do that could do so.....whereupon Chinakwe might re-consider.

 

There are no universal guides to sensibilities.  What might be offensive in one context - place and time - might not be in another context.  Yes, we might learn from laws and actions in America and China and Latvia and Nigeria, but to think that reactions will be the same everywhere is jejune.

 

Finally, as a Christian, I don't spend too much time on religious relativism.  The general notion among Christians is that our God can fight for Himself - "Revenge is mine, says the Lord", so whoever goes fighting and maiming others because they desecrate Jesus Christ or God Almighty or the Bible has himself or herself to blame for whatever punishment he or she faces.  I am certain that God will not welcome him to Heaven saying, "Well fought, good Child of God."  The New Testament also says that if you are not accepted in a city - which may be part or all of a City - wipe your feet from that city and move on.  It is not cowardice, but wisdom (and God's plan) that it may be a sign that you are needed more in another city!

 

It may be different in other religions, but that is their business, but I better be aware of it, so that I don't act unguided or foolish.

In the civilized world, the police protected the paintings and or sculptor and the artist, Chris Ofili. When he got to NYC, the Mayor Guilliani who is a Catholic and sees the Virgin Mary as too symbolic to be so defiled, went to court, stopped the subsidy of $7m that the city gives annually to the Museum that displayed the artist's "dumb paintings".

Guess what my peoples, Dumb guy and very offensive and provocative guy Ofili and the museum won the court case, well protected under the first amendment.

 

 

My people, Chris Ofili is still alive. No Christian burn down Brooklyn Museum. And if there exists anything that can be deemed "offensive", anything more "provocative", something more prune "to cause breach of peace", I will say it is a painting of a religious symbol defaced with shit and presented to millions of Christians as "in your face" insult.

I am not pointing out the errors of African ways in order to score points on mere debate. To me it is more than a debate, it is part of my rejection of Nigeria as a country.

When those who supposed to protect have no clue on what and whom to protect and serve, that country is in crisis.

When what should be protected is turned into a crime, and a tribe is rated superior, its religion protected because the tribe's Intolerance may "cause a breach of peace".

It is Intolerance we witness but called "potential causation of breach of peace".

Admittedly sometimes a protected speech may tend to ignite "breach of peace" such as the Ofili's Dumb art, such as the newspaper office that was bombed in Europe. 

While Christians were more refrained and refused to escalate their anger to a murderous point, what we see in my view, is a Muslim outrage causing deaths and havoc around the world.

 

I just happened to be a neutral guy stuck among two imperfect religious Minds who strongly believed in separate but equal perfection of their Deities. 

I look at situations globally not as mere isolated incidents, thus my shout out.

I don't see Chinakwe's "dog naming" rights isolated from Ofili's rights, nor do I see Hebdo's attack isolated from the recent killing of that igbo woman who was killed because he insulted  Islam.

I know I know, I see no good coming out of Nigeria, oh do I wish I was wrong!

 

People have been beheaded all over the world because they dared to utter mere words against Prophet Mohammed, I don't see these deaths as isolated from the deaths of thousands of Christians who had been killed in the North by Homicidal Muslims just because they dared to utter words by reading aloud their books called the Bible. 

We may say that was dumb of a Christian to open a church in a known hostile territory, we may even see such dumbness as "provocative" or offensive enough "to cause breach of peace", it may offend "one person", but this is a right worth protecting. Little incidents and reactions thereof tell of the commitment of a people to protect all rights in their land.

I'm truly disappointed with our reactions generally when rights are breached by governments in Nigeria, how we rationalize and blame the real victim truly confound me.

 

I find Nigerians unwilling to understand Freedom of Speech, part of which protects religion and utterances which may be deemed offensive but belong to the bearer and shouldn't be taken away or criminalized.

Nigeria can't get anywhere if one part is overly protected and allowed to overpower others be it gradual or forcefully, because in the long run, even shearing your Aladura sutana beyond a room, may offend these people you all are protecting.

These people won't stop until they make you into what their Qur'an ordered.

Mr. Adeyanju, who is a young and rising bright star in Nigeria's political firmament, is absolutely right. 

When the likes of Mrs. Oby Ezekwezile, the former Minister of Education and a hitherto great supporter and friend of the Buhari administration can publicly proclaim that

"President Buhari does not deserve to be President", then you know that this government has indeed gone beyond the pale, that the meltdown has started and that the corpses are beginning to smell. 

Yet nothing is more indicative of the Federal  Government's misplaced priorities and more reflective of their total and complete moral degeneration and psychotic paranoia than their behaviour towards the owner of a dog that was named Buhari. Consider the following.

We took advantage of his meekness, decency, sense of restraint and humility and we took the basic freedoms that he gave us for granted. It didn't stop there.

On several occasions during the course of the 2015 presidential election campaign he was stoned in parts of the core north by violent groups of hungry-looking and thuggish almajiris whilst the First Lady, Mrs. Patience Jonathan, was unfairly and cruelly portrayed as an illiterate, a drama queen, a clown and somethiing akin to a female court jester. 

She was even referred to as a "hipoppotomos" by no less a person than our Nobel Laureate, Professor Wole Soyinka whilst Jonathan himself was described as "a pig" by Mr. Japhet Omojuwa, a young and dynamic blogger and political commentator.

Yet despite all these unwarranted, crude and provocative insults the President did not lose his cool, the heavens did not fall and his government did not query, warn, threaten or arrest anyone. 

One year and two months later things appear to be very different. Permit me to explain. A few days ago a man who named his dog "Buhari" was promptly arrested by the police and remanded in custody. His name is Joachim Chinakwe and he lives in Ogun state. 

The police told members of an incredulous public that they took and kept Mr. Chinakwe in custody "for his own safety" and that they intended to arraign him in a court of law in a matter of days for having the effontry to name his dog "Buhari". 

According to them, giving his dog that name was a provocative act that could have lead to an ethnic and religious conflict because Mr. Chinakwe's neighbours were Hausa-Fulani.

Apparantly those neighbours were not too happy with the name that he had given to the dog, in view of the fact that our President shares the same name, and therefore they threatened to kill him for it. 

As far as I am aware this is the first time in the history of our country that anyone has been arrested simply because his dog shares the same name as our President. 

It is also the first time that the victim of a serious crime and an individual whose life was threatened ended up being thrown behind bars whilst those that threatened to take that life ended up being the complainants in the case. 

And all this because of a poor dog named Buhari which, we are told, had to be quietly put down and sent to the great beyond by its owner so that it couldn't be used as evidence against him in court! 

The whole episode sounds like a second rate Hollywood script but sadly it really happened. I guess that is "Mai Chanji" for you.

Yet examples of the startling contrasts that exist between the Jonathan era and the one that we are in today refuse to abate. 

Things have got so bad in this country that Mr. Ebube, a regular and increasingly  influential commentator on Twitter, posted the following words on his handle yesterday. He wrote, 

"Under this misfortune called APC people are  arrested for writing about EFCC, naming a dog and criticising a governor".

I guess that is Mai Chanji for you.

When one considers the economic situation things are even worse. Mr. Oshioke Audu, a public commentator, put it well when he posted the following words on Facebook. He wrote, 

"Twenty  years ago the South African economy was 7.5 times the size of the Nigerian one. At the end of 2012 the South African economy was only 1.4 times the size of the Nigerian one. By 2014 Nigeria officially became Africa's number one economy and the 23rd in the world. Then the APC took over with inept Buhari in 2015. By 2016, Nigeria is now the 40th  world economy and the third in Africa". 

What a tragedy! Yet no-one captures it better than a young and courageous politician from Anambra state by the name of Prince Henry Nwazuruahu Shield who wrote the following on Facbook:

"Recession does not speak politics. It is simply a result of one man's ignorance about the management of the economy. A robust economy benefits both APC supporters and PDP's. We need to agree that Buhari is the SOLE problem of Nigeria".

This insightful young man has hit the nail on the head.

Permit me to conclude this contribution by touching on a matter that has brought many of us in the Christian community immense sorrow.

Southern Kaduna is on fire and its people are being slaughtered on a daily basis by blood-sucking Fulani herdsmen. Despite thils the Federal Government has done nothing to abate it or to bring the perpertrators to justice. 

The truth is that those that commit these heinous crimes and their powerful rich friends that secretly buy them arms and that covertly encourage, protect and support them are nothing but the sons of Lucifer: they are  the seed of Al Shaitan.
