I am with the retired Justice Stevens on this one. If 2A means what the NRA says it means, then it should be repealed. I have read amendment several times and cannot understand the minds that say that it gives citizens the right to (unconditionally) bear arms, as in this statement "The Second Amendment to the United States Constitution protects the right of the people to keep and bear arms". In 1791 when this was ratified we did not have AR 15s and the likes to kill dozens of people in a short period of time, but the part that bothers me the most is the "well-regulated Militia" part, which appears not to be part of any argument in defense of the righto bear arms.
My understanding is that the right to bear arms is for "the security of a free State" and that bearers of Arms would be part of "A well-regulated Militia" as in the National Guard, The Army, Navy, Marines, Air Force and Coast Guard. Granted, there were days when we did not have standing armed forces to secure the State, and individuals had to dig into their personal arsenal to defend the village. Back then, it was necessary to have a bow and arrow around, or a single or double barreled-gun, not just to hunt, but to ward off the other villagers who might want to trespass.
If the sound of an AR 15 is so enthralling why not go to a shooting range; use them and leave them there as we do when we feel like practicing our golf strokes? Why would anybody need that kind of machine for anything? The argument that the right to bear arms shall not be infringed logically, should also allow people to have RPGs and ICBMs, those can secure the free State better.
Perhaps the lawyers on the forum can shed some light.
