USA Africa Dialogue Series - THE EVIL SAMARITANS AND THE NIGERIAN PRESIDENTIAL ELECTIONS

​After World War II the carnivores from Europe and the US decided to grant independence to the herbivores of Africa. African herbivores thought that change of hearts had occurred in the carnivores, who for centuries have been feeding on the flesh of Africans, would thenceforth learn to be herbivores just like Africans. Instead, the carnivores insisted that they would teach and help herbivores to become carnivores and thereby, in the beginning, called the African herbivores underdeveloped carnivores but changed that later to developing carnivores. Africans who did not believe that Euro-American carnivores will ever allow Africans to become carnivores like themselves asked whose flesh would Africans feed on if they turned carnivorous? Such Africans, like Patrice Lumumba, Steve Biko, Thomas Sankara and others, were immediately dubbed communists or extremists and eliminated by Euro-American carnivores. Thereafter, the carnivores converted some Africans to cannibals and made them leaders in respective African countries. The Euro-American carnivores and the Africans they convert to cannibals, today, feed economically on the African masses. Yet, those who exploit and impoverish Africans attribute their behaviours to love of Africa. It is such love that the evil Samaritans are now exhibiting in the forthcoming Presidential Elections in Nigeria. 

Since Nigeria's independence in 1960, Euro-Americans who claim to love Nigerians and know the best way for Nigeria's rapid economic development have proposed and forced Nigerian leaders to execute many programmes. At the end of each economic program Nigeria and her people had become poorer. Any independent action by Nigerian leaders, even when it has nothing to do with economic politics, is immediately opposed by the evil Samaritans. It is worthwhile recalling that when the Nigerian National Assembly, in 2013, passed a law prohibiting same sex marriage in Nigeria and stipulated long term imprisonment for contravention of the law which was signed into law by President Jonathan, President Barack Obama (US), President Francois Hollande (France) and Prime Minister, David Cameron (UK) threatened Nigeria with economic sanction. Yet, the immediate need of Nigerians was not freedom to practice homosexuality or tribadism. People were not queuing for same sex marriage, a strange phenomenon in Nigeria where, because of level of economic development, producing children is the only social insurance for old age care. In our indigenous languages, there are no equivalent words for homosexuality or tribadism and majority of Nigerians, except a very negligible minority of Western educated, do not know what those sexual perversities entail. Nigeria's National Assembly and the Government were dissipating energy on solving non-existing problem for Nigerians as the evil Samaritans rose up to defend the so called human rights of imaginary and non-identifiable gay groups in Nigeria. Human rights of Nigerian children of school age to have access to free primary education was of no concern to the Nigerian government and the evil Samaritans, neither were the two sides interested in rights of Nigerians to constant electric lights, potable water nor to modern housing. In fact, funds appropriated for all the aforementioned life- comforting projects in Nigeria were stolen by public officials to buy properties in the Western world while the remaining part of the funds were kept in Western banks. The evil Samaritans who always pretend to love Nigerian people so much accepted Nigeria's stolen developmental money into their countries while they were combat ready to force Nigerians to be gays. The evil Samaritans mouth anti-corruption while they welcome money stolen from Nigeria into their countries which is why a large chunk of money stolen in Nigeria are in Europe and the US.

Following the suspension of Chief Justice Onnoghen by President Buhari in compliance with the order of Code of Conduct Tribunal the Embassy of the United States in Nigeria  on 26 January 2019 issued the following statements : The Embassy of the United States is deeply concerned by the impact of the executive branch's decision to suspend and replace the Chief Justice and head of the judicial branch without the support of the legislative branch on the eve of national and state elections. We note widespread Nigerian criticism that this decision is unconstitutional and it undermines the independence of the judicial branch. That undercuts the stated determination of government, candidates, and political leaders to ensure that the elections proceed in a way that is free, fair, transparent, and peaceful - leading to credible results. We urge that the issues raised by this decision be resolved swiftly and peacefully in accordance with due process, full respect for the rule of law and the spirit of the Constitution of Nigeria. Such action is needed urgently now to ensure that this decision does not cast a pall over the electoral process. On the same day, the European Union issued the following statements : The European Union was invited by the Independent National Electoral Commission to observe the 2019 general elections. The EU Election Observation Commission (EU EOC) is very concerned about the process and timing of the suspension of the Chief Justice of Nigeria, Honourable Justice Walter Onnoghen on January. With 20 days until presidential and National Assembly elections, political parties, candidates and voters must be able to have confidence in the impartiality and independence of the judicial system. … //…  The timing, just before the swearing in of Justices for Electoral Tribunals and hearing of election related cases, has also raised concerns about the opportunity for electoral justice. The interference in the forthcoming general elections in Nigeria by the Embassy of the United States in Nigeria as well as that of the INEC's invited EU election observers deserves some clarifying questions. What makes the Embassy of the United States in Nigeria to imagine that the suspension of Chief Justice Onnoghen would cast a pall over the electoral process? What has suspension of the CJN to do with election process? What has free, fair, transparent and peaceful elections, leading to credible elections, to do with the suspension of CJN and the appointment of an acting CJN? On what ground is American Embassy in Nigeria basing his tacit belief that the acting CJN would be partial? Who has made the American Embassy in Nigeria the interpreter of the Nigerian Constitution? Why is EU election observation commission concerned about the process and timing of the suspension of CJN Onnoghen? What makes EU EOC to imagine that the retention in office of CJN Onnoghen would make Nigerian voters to have implicit confidence in the impartiality and independence of the judicial system? On what does EU EOC base its belief that the acting CJN would be partial and not safeguard the independence of the judiciary?

​It is remarkable that the main challenger to President Buhari in the 16 February election is Atiku Abubakar. This same Atiku Abubakar was the main target in the US Attorney's letter of 22 June 2006 to the EFCC, requesting him to be investigated for corruption, fraud and money laundering. The US  authorities had stumbled over Atiku Abubakar's name while investigating corruption case against an American Congressman, William Jefferson. In a US Congress report written by Carl Levin led Permanent Subcommittee on Investigation, a Seventy-page portion of the report was titled : ATIKU ABUBAKAR CASE STUDY - USING OFFSHORE COMPANIES TO BRING SUSPECT FUNDS INTO THE UNITED STATES. Page 173 of the Congress Report reads, "Ms Douglas helped her husband bring over $40 million in suspect funds into the United States, including at least $1.7 million in Bribe payments from Siemens AG, a German Corporation, and over $38 million from little known offshore corporations primarily, LetsGO Ltd. Inc., Guernsey Trust Company Nigeria Ltd, and Sima Holding Ltd." The name of Atiku's fourth wife is Jennifer Iwenjiora but while in the US she answered Jennifer Douglas and later known as Jamila Atiku Abubakar. On Atiku and his wife, Jennifer, Obasanjo wrote in Volume two of his book , My Watch, "As it turned out the investigation in Nigeria and in the US led to Atiku's house (in the US) being searched by the US Bureau of Investigation (FBI), the arrest and detention of his newly married wife Jennifer. She was declared wanted at one time (she hurriedly left US and settled in one of her husband's mansions in Dubai). It was so embarrassing for our Administration and Embassy in Washington under Ambassador George Obiozor (p. 191-192)." Since 2006, Atiku Abubakar was unable to visit US for fear of being arrested according to the aforementioned corrupt and money laundering investigations carried out on him both in Nigeria and the US. Suddenly, in January 2019, the US Embassy in Nigeria granted him a temporary visa to visit US and his previous crimes of corruption and money laundering in the US were temporarily waved aside. That indicates that the choice of the present regime in the USA for the President of Nigeria in the forthcoming general elections is Atiku Abubakar. On a report monitored by Channels TV in Nigeria on Thursday, 7 February 2019, the Ambassador of US in Nigeria, Mr Stuart Symington, warned on taking and implementing illegal directives issued in the name of President Muhammadu Buhari to manipulate the elections. He was speaking to journalists in Makurdi, Benue State, after his meeting with the State's Governor, Samuel Ortom, who defected from APC to PDP in 2018. Can Nigeria Embassy in the US actively participate in a US election campaigns in favour of one of the contesting candidates?

The EU EOC in their imagination averred that the timing (for the suspension of CJN Onnoghen), just before the swearing in of Justices for Electoral Tribunals and hearing of election related cases, has also raised concerns about the opportunity for electoral justice. The European Union Election Observation Commission has been invited voluntarily by the Independent National Electoral Commission of Nigeria to observe the conducts of the 2019 elections. It is highly irresponsible of the EU EOC to extend their observation duties to include how the Nigerian Judiciary functions. Here, the EU EOC misunderstood its mission and went astray because the Chief Justice of Nigeria has no role in the selection of Election Petition Tribunal Justices. They are selected by the President of the Court of Appeal and are only ceremoniously inaugurated by the Chief Justice of Nigeria. That the inauguration of the Election Petition Tribunal Justices was conducted by an acting Chief Justice had no negative impact.

The US and the EU have shown concern about the suspension of Chief Justice Onnoghen but they have treacherously pretended not to know why he was suspended. The Constitution or the law cannot envisage all eventualities. The Chief Justice of Nigeria, Walter Samuel Nkanu Onnoghen, admitted to violating Section 15(1) of the Code of Conduct Bureau and Tribunal Act Cap c15 LFN 2004 which is punishable under Sec 23 (2) a, b, and c of the same Act. It was not only that CJN Onnoghen failed to declare his assets as required by law, he also admitted in writing that he forgot that he had foreign currencies bank accounts in Nigeria to declare. A perusal of Chief Justice Onnoghen's domiciliary dollar account No.0001062650 at Standard Chartered Bank (Nig) Ltd in Abuja revealed the following :- Onnoghen personally made five different cash deposits of $10,000 each on 8 March 2011 (total$50,000); two separate cash deposits of $5,000 each (total $10,000) followed on the same day by four cash deposits of $10,000 each (total $40,000) on 7 June 2011; another set of five separate cash deposits of $10,000 each (total $50,000) on 27 June 2011; and four separate cash deposits of$10,000 each (total$40,000) on 28 June 2011. That was just a small portion of what Onnoghen claimed he forgot to declare. The patterns and manners of depositing the dollars into his account showed crookedness, practised commonly by criminals. In the countries of European Union and in the United States of America, can a Chief law officer commit the type of crime which Chief Justice Onnoghen admitted in writing that he had committed, but blamed the crime of forgetfulness, be allowed to preside over cases and judge others? It is true that the Constitution empowers the National Judicial Council (NJC) to discipline judicial officers. NJC is headed by CJN as the chairman, who is Onnoghen. The 88th meeting of NJC was already summoned and scheduled to take place on 15 January 2019 but in order to avoid NJC query, Onnoghen adjourned the NJC meeting indefinitely. The framers of the Constitution never envisaged that CJN who is the chairman of NJC would ever be enmeshed in any criminal activity. In such a situation, commonsense demands that due process must give way to necessary process in order to save the image of the Judiciary. Nigeria was confronted with similar situation when President Umaru Musa Yar'Adua was sick, because he did not, according to the Constitution, inform the National Assembly in writing that he was sick and that his vice should act for him. Yes, the Constitution did not envisage that the president could fall into coma and be unable to communicate with the National Assembly in writing. The dilemma was, however, resolved through what the National Assembly called Doctrine of Necessity, whereby Vice President Goodluck Jonathan was made Acting President in February 2010. If due process were to be followed Nigeria would not have had a President until Yar'Adua's death in May 2010, when Jonathan became substantive President. Hanging on the suspension of a criminal Chief Justice to forecast the incredibility of the forthcoming Presidential elections in Nigeria is dishonest and evil. The evil Samaritans think that the resources of Nigeria belong to them and Nigerians have to do whatever they tell them to do, otherwise they will chain them up in perpetuity as they did in Congo, Libya and Somalia. Unfortunately, Nigeria has traitorous political leaders and public officials who steal funds appropriated for social and economic development of Nigeria and keep them in the banks of the evil Samaritans who gladly accept them. In the United Kingdom, The Unexplained Wealth Orders which came into force from February 2018 requires foreigners who owns properties, including money to explain the source of their funds or risk forfeiting them to the government of UK. Billions of dollars kept by Nigeria's former Petroleum Minister and his aides might have been sucked by UK's Unexplained Wealth Order. That might be the cause of Britain's refusal to repatriate her to Nigeria for trial. In the US, the Department of Justice has procured Kleptocracy Asset Recovery Initiative which is deployed in seeking forfeiture of proceeds of foreign corruption. According to Reuters, the US Department of Justice filed a lawsuit seeking the recovery of assets from Nigerian business associates of the former Nigerian oil minister, Diezani Alison-Madueke. Acting Assistant Attorney General, Blanco said that despite being unqualified and in some instances failing entirely to perform services under the contracts, the business associates of Diezani received on behalf of their companies more than $1.5 billion in revenues from sales of crude oil paid and laundered in the US. The lawsuit claimed that Alinson-Madueke steered lucrative contracts with a subsidiary of Nigerian National Petroleum Corporation to companies owned by Alinson-Madueke's business associates. ​When Nigerians vote on 16 February 2019, they should demonstrate that those who think that Nigeria is a shithole are themselves beset with shit-brain.
