Atiku Abubakar lied when he associated himself with forming Action Congress of Nigeria (ACN) in 2007. The fact is that Action Congress (AC) founded by Bola Ahmed Tinubu did not become ACN until December 2010. In 2006, Atiku Abubakar was Vice President to President Olusegun Obasanjo who was determined to prevent Abubakar from succeeding him as President in 2007 on the platform of their party, PDP. So, in 2006, Bola Ahmed Tinubu offered Atiku Abubakar the AC platform to contest the presidential election scheduled to take place on 21 April 2007. As a political bigamist, Atiku Abubakar remained Vice President on the platform of PDP while at the same time he was sleeping with AC as their presidential flag bearer for 2007. Attempt by the PDP to remove Atiku Abubakar from office as PDP Vice President of Nigeria on account of his political whoredom with Action Congress failed because of the Supreme Court decision. However, Obasanjo set up different administrative panel of enquiries that found Atiku Abubakar guilty of embezzlement and fraud which he forwarded to INEC in 2006. Based on those reports from Obasanjo's panels on Atiku, INEC disqualified Atiku Abubakar from contesting the upcoming Presidential election in April 2007. AC then filed a constitutional case against INEC at the Supreme Court.
On Monday, 26 June 2006, the Supreme Court of Nigeria delivered judgment in the case, AC vs INEC, in which AC asked the Apex court to decide if INEC had the power to disqualify a candidate from contesting in an election. In its decision on that day of June 26, 2006, the Supreme Court said, "Section 36(5) of the 1999 Constitution demands that every person who is charged with a criminal offence should be presumed to be innocent until proved guilty. The trial and conviction by a court is the only constitutionally permitted way to prove guilt and therefore the only ground for the imposition of criminal punishment or penalty for the criminal offences of embezzlement or fraud. The imposition of penalty of disqualification for embezzlement or fraud on the basis of an indictment for these offences by an administrative panel of inquiry implied presumption of guilt contrary to Section 36(5) of the Constitution of the Federal Republic of Nigeria, 1999. An indictment is no more than an accusation. Allegations of embezzlement or fraud are beyond the reach of an administrative panel and has to be pronounced upon by the Courts." Consequently, the disqualification of AC candidate, Atiku Abubakar, to participate in the 2007 presidential election by the INEC was nullified by the Supreme Court of Nigeria. Please, note that the case was initiated by AC against INEC and not ACN, which was non-existing then, against INEC as Atiku Abubakar dishonestly claimed at his World Press Conference of Thursday, October 5, 2023.
What Atiku Abubakar worships is money and power and not any noble, higher ideals of honour, principle, love, fellow-feeling and decency. His belief, always, is that others exist only to serve his greed. After the demise of President Yar 'Adua, May 2010, his Vice, Goodluck Jonathan, became substantive president and Atiku Abubakar calculated coldly that Jonathan was not going to contest in the 2011 presidential election, since according to the PDP constitution it was a northerner that should be President of Nigeria after Obasanjo's eight years presidency. Therefore, Atiku Abubakar sneaked back into the PDP and did everything possible to hinder the sitting president, Goodluck Jonathan, from contesting the 2011 presidential election. He contested presidential primary against Jonathan but Atiku lost. Mr. Abubakar consoled himself by thinking that four years run fast and that Jonathan would not seek re-election in 2015 but once again Jonathan floored him and the opportunist, Abubakar, openly crawled to join APC to contest its December 2014 presidential primary which he lost to Muhammadu Buhari who subsequently won against Jonathan. After the defeat of Jonathan, PDP was in disarray and Atiku, the political prostitute without principle and ideology shamelessly re-joined the PDP to become its presidential flag bearer in 2019. Chronologically viewed, it was Atiku political waywardness that made him to swing from AC, that became ACN in 2010, and not because Tinubu did not support him against Yar' Adua in 2006.
If the Supreme Court decision in AC versus INEC in 2006 is juxtaposed on the current Atiku Abubakar's claim that Bola Ahmed Tinubu forged his academic credentials he submitted to INEC in 2022, one will discover that no court, either in Nigeria or USA, has found Bola Ahmed Tinubu guilty of certificate forgery. It was Atiku's devil advocate in Atlanta, despite affirming that Tinubu really attended Chicago State University and graduated there, who began to guess that the certificate submitted to INEC in 2022 by Tinubu was forged and his hunch (suspicion) was that the certificate with which Bola Ahmed Tinubu gained admission into CSU did not belong to him. Yet, the devil advocate confirmed that Tinubu performed well with honours. The menopaused intellectual Atiku is now presenting his devil advocate's presumptions on a probable forgery and fraud by Tinubu as if it were a court decision contrary to Section 36 (5) of the Nigerian Constitution that says that every person who is charged with a criminal offence should be presumed innocent until proven to be guilty. Bola Ahmed Tinubu has not been charged in any court of law for forgery and fraud much less being convicted. That is an indisputable fact.
On Tuesday, October 3, 2023, CSU's Registrar, Caleb Westberg, testified in Court to confirm that Bola Ahmed Tinubu who attended Southwest College is the same person who attended and graduated from the 156-year-old institution in 1979 and also the same person sitting in Aso Rock Villa as President of Nigeria. The Registrar's testimonies are contained in a disposition he made in the Office of Angela Liu, Dechert LLP, on 35 West Wacker Drive, Suite 3400, Chicago, IL 60 601, United States. Mr. Westberg emphasised further that the admission letter issued to Tinubu showed that the Student who schooled there from 1977 to 1979 was a male. The letter of admission sent to him began with, "Dear Mr. Tinubu." With the evidence procured from the records of Tinubu released by the CSU, what Atiku Abubakar are doing with it amounts to pure character assassination with intention to demean and rubbish the image of the President of Nigeria. The damage done to Tinubu personally and the image of Nigeria by Atiku Abubakar in referring to Tinubu as a certificate forger is immeasurable in financial terms. Citing the Judicial Act 87, Subsection 390 of 1968 (as amended) the Presidential Election Petition Tribunal (PEPT) in its judgment of Wednesday, September 6, 2023, sapped the Labour Party, PDP and APM for frivolous petitions which the Court described as "in-congruous, incompetent, nebulous, unmeritorious, fallacious, defective, mischievous and beyond repairs. Thus, the Court fined the LP N47,910,431.78; the PDP N23, 391,001.45; and the APM N13,675,890. In view of this, and considering the immeasurable damage done to the image of Nigeria and the person of Bola Ahmed Tinubu by portraying the president to the whole world as a certificate forger (drug baron), the Supreme Court of Nigeria should fine the propagators of such false accusation trillions of naira to teach future politicians that false accusation is not accepted in practical politics.
Dr Emery Patrick Effiboley has proposed that future presidential candidates should show the proof of their certificates/degrees before their candidacy could be validated by INEC. At moment, Part IV, Article 318(1) (c) of the 1999 Constitution stipulates that Primary School Leaving Certificate is the minimum qualification for any presidential candidate as well as in 318 (1) (c) (iii) the ability of the candidate to read, write, understand and communicate in the English language to the satisfaction of INEC. Not done, Section 318 (1) (d) stipulates that a presidential aspirant can present any other qualification acceptable by the Independent National Electoral Commission. With the afore cited portion of the constitution, INEC has approved all the certificates of presidential candidates in the 2023 elections but politicians will never accept INEC's decision or approvals. Even if INEC were to disapprove any certificate tendered to it by a candidate, it has to go to a court of law to get the candidate disqualified.
And much to do about certificate, we got to know that Andrew Johnson the 17th President of the United States from 1865 to 1869 was a tailor apprentice. He was an illiterate when he got married at the age of 18 to the 16-year-old Eliza Mc Cardle, a daughter of a local shoe-maker, in 1827. Andrew Johnson's wife taught him how to read and write. Andrew Johnson was elected a Mayor, member of Tennessee House of Representatives and later member of the US Congress where he served for ten years from 1843 to 1853. He was Governor of Tennessee from 1853-1857 and a US Senator from 1857 to 1862 and he was a military governor of occupied Tennessee during the civil war between 1862 and 1865.. On March 4, 1865, Andrew Johnson was elected Vice President to Abraham Lincoln in his second term and 42 days later, when President Lincoln was assassinated, Andrew Johnson was sworn in as the President of the USA. There is difference between native intelligence and book intelligence. The debate over the academic worth of Bola Ahmed Tinubu to be President of Nigeria is primitive and reactionary, and anybody can see that except those who are suffering from intellectual menopause.
