The International Criminal Court's (ICC) arrest warrant against Benjamin Netanyahu for suspected war crimes is a heavy blow to Israel. The country's leaders are placed in the same category as the terrorist group Hamas. But there is concern in The Hague that US sanctions against the ICC could mean the end of the court.

The arrest warrant against Israel's prime minister and former defense minister has several immediate consequences. The first is that Benjamin Netanyahu and Yoav Gallant cannot visit the 123 countries that are part of the ICC without risking arrest.
The court's decision also divides the world community. Dutch Foreign Minister Caspar Veldkamp declared that Netanyahu will be arrested if he visits the country.
The EU's foreign representative Josep Borrell also backs the ICC decision, which he claims "must be respected and applied".
The Israeli government's allies in the world, on the other hand, oppose the search. Hungarian Prime Minister Viktor Orbán said immediately after the announcement from The Hague that he intends to invite Netanyahu to Hungary and that he does not intend to follow the order to arrest him. This despite the fact that Hungary is one of the countries that has supported the Rome Statute that established the ICC just over 20 years ago. According to the Rome Statute, all member states are obliged to arrest persons wanted by the ICC who set foot in their country.

That provision prevented Russian President Vladimir Putin, who is wanted by the ICC for war crimes in Ukraine, last year from taking the risk of traveling to South Africa to attend the Brics summit.
Considerably more important is the attitude of the United States, despite the fact that the country does not belong to the Criminal Court. President Joe Biden condemned the ICC's decision: "We fundamentally reject the court's decision. There is no equivalence between Israel and Hamas," the White House press secretary explained.
The reaction seems to open to the US being accused of double standards. When the ICC in March 2023 issued an arrest warrant against Putin, the tone of Biden was only positive.

Even more serious is the threat of drastic sanctions against the ICC from the US side. Already in May, when the ICC's chief prosecutor, Karim Khan, requested that an arrest warrant be issued against Netanyahu , Gallant and three Hamas leaders, several Republican politicians launched a violent counterattack against the court. The Republican-controlled House of Representatives passed in June – with the support of 203 Republicans and 42 Democrats – a bill to impose sanctions on the ICC.

The sanctions could mean that ICC officials involved in prosecutions of "US allies" could be stripped of their US visas and have their bank accounts blocked. In practice, this can mean such things as a travel ban, that wages cannot be paid and that insurance does not apply.
If the threat of sanctions against the ICC and its associates is realized, many in The Hague fear that the court cannot function and thus will not survive. Among the nearly 1,000 employees from 100 countries who are employed by the ICC, there is therefore great uncertainty about the future.
That concern is confirmed by an editorial in the conservative Wall Street Journal: "Cutting off the ICC and, say, its 100 top officials from the US banking system via sanctions — with all that means for European bank accounts as well — could cripple the court."
In order for the law to come into force, the Senate must pass it. Currently, the Senate has a Democratic majority, and it is unclear whether the bill will come up for consideration before the end of the year.

But from January, the Republicans also gain control of the Senate. Then there is nothing to prevent the law from being passed, and when Donald Trump takes office as president on January 20, he will not hesitate to sign it.
If the issue is stalled in Congress for any reason, the president can also impose sanctions through executive orders.
The upcoming sanctions decision seems to be well prepared. Mike Waltz, whom Trump has nominated as national security adviser, says he is ready to act: "The ICC has no credibility. Israel has lawfully defended its people from genocidal terrorists. One can expect a strong response to the anti-Semitic prejudices of the ICC and the UN in January".
Incoming Republican Majority Leader John Thune says he intends to try to get outgoing Democratic Leader Chuck Schumer to hold a vote on the law as soon as possible: "Unless the ICC and its prosecutors change their outrageous and illegal actions... the Senate must immediately pass the law."

His colleague, Senator Lindsey Graham, writes on X that he intends to present another law that is even more far-reaching. Also persons and countries that "assist and assist the ICC in harming the security of the United States" should be able to be sanctioned.
This means that witnesses called by the court, such as human rights activists who share information about suspected Israeli war crimes with the ICC, can be punished. But also representatives of other states.

● The war crimes for which Hamas military leader Muhammad Deif is suspected relate to what happened during the attack into Israel on October 7 and after: murder of hundreds of civilians, hostage-taking, rape and other sexual violence and cruel treatment of prisoners. Karim Khan also wanted to call for two other Hamas leaders, Yahya Sinwar and Ismail Haniyeh, but they have been killed by Israel. According to Israel, Muhammad Deif is also no longer alive, but the ICC has not been able to confirm this.
